These Terms and Conditions govern your access to and use of tigerenergystorage.com and any webpages, features, or content made available through it, collectively referred to as the Site. The Site is provided by Tiger Energy Storage, a project of New Leaf Energy, Inc. References to Tiger Energy Storage, New Leaf Energy, we, us, or our include New Leaf Energy, Inc. and its affiliates, representatives, and project partners, as applicable. 

  

By accessing or using the Site, you agree to these Terms and Conditions. If you do not agree, please do not use the Site. 

  

1 Site Purpose 

  

The Site provides general information about the proposed Tiger Energy Storage project and related topics. Site content is provided for public information and community engagement. It does not constitute legal, engineering, financial, investment, environmental, land-use, permitting, safety, or other professional advice. Site content does not replace official filings, permit materials, public notices, agency records, or final project documents. 

  

Project plans, schedules, features, benefits, approvals, and other information may change as development and review continue. Nothing on the Site is a promise, guarantee, offer, contract, or representation that the project will be approved, constructed, or operated as described. 

  

2 Eligibility and Acceptance 

  

You may use the Site only if you can form a binding agreement under applicable law. If you use the Site on behalf of an organization, you represent that you are authorized to accept these Terms and Conditions for that organization. 

  

3 Permitted Use 

  

You may access and use the Site for lawful, personal, informational, and noncommercial purposes. You may download or print reasonable portions of Site content for those purposes, provided that you keep any copyright, trademark, and other ownership notices intact. 

  

4 Prohibited Conduct

Interfere with the Site, its security, or another person’s use of the Site. 

  

Attempt to gain unauthorized access to the Site, its systems, accounts, or data.

5 Information You Submit 

  

The Site may allow you to contact us, ask questions, request information, or subscribe to email updates. You agree that information you submit will be accurate, lawful, and submitted by you or with proper authorization. Do not submit confidential, proprietary, financial, health, government identification, or other sensitive information through general Site forms. 

  

You grant us a nonexclusive, worldwide, royalty-free right to use, reproduce, and share your submission as reasonably necessary to respond to you, administer the Site, evaluate project-related feedback, comply with law, and protect our rights. This license does not transfer ownership of your submission to us. 

  

Submitting a message does not create a confidential, fiduciary, advisory, employment, agency, or other special relationship with us. 

  

6 Email Communications 

  

If you subscribe to project updates, you authorize us and our service providers to send informational and promotional emails related to Tiger Energy Storage, New Leaf Energy, and related activities. You may unsubscribe from marketing emails using the link included in the message or by contacting us. We may still send nonmarketing communications when needed to respond to a request or administer a relationship with you. 

  

7 Intellectual Property 

  

The Site and its content, including text, graphics, photographs, maps, designs, logos, icons, videos, and software, are owned by or licensed to New Leaf Energy, Inc. and are protected by intellectual property laws. Tiger Energy Storage, New Leaf Energy, and their associated names, logos, and designs may be trademarks or service marks. No license or right is granted except the limited permission to use the Site stated in these Terms and Conditions. 

  

8 Third Party Services and Links 

  

The Site may contain links to, or embedded content from, third-party websites and services, such as mapping, video, analytics, and email platforms. Third parties operate under their own terms and privacy practices. We do not control and are not responsible for their availability, security, accuracy, content, or practices. A link or embed does not necessarily mean that we endorse the third party. 

  

9 Accuracy and Availability 

  

We seek to provide useful and current information, but we do not warrant that Site content is complete, accurate, current, or free from errors. We may change, remove, suspend, or discontinue any part of the Site at any time. We do not guarantee that the Site will be uninterrupted, secure, or free from harmful components.

WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. 

  

Some jurisdictions do not allow certain warranty exclusions, so some of the exclusions above may not apply to you. 

  

11 Limitation of Liability 

  

TO THE FULLEST EXTENT PERMITTED BY LAW, NEW LEAF ENERGY, INC., ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, PROJECT PARTNERS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, BUSINESS, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS AND CONDITIONS, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR. 

  

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS AND CONDITIONS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS. The limitations in this section apply regardless of the legal theory asserted. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you. 

  

12 Indemnification 

  

To the extent permitted by law, you agree to defend, indemnify, and hold harmless New Leaf Energy, Inc., its affiliates, and their respective officers, directors, employees, agents, contractors, and project partners from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms and Conditions, or your infringement of another person’s rights. 

  

13 Suspension and Termination 

  

We may restrict, suspend, or terminate your access to the Site if we reasonably believe you violated these Terms and Conditions, created risk or possible legal exposure, or interfered with Site operations. Provisions that by their nature should survive termination will continue to apply, including provisions concerning ownership, disclaimers, liability, indemnification, and dispute terms. 

  

14 Governing Law and Venue 

  

These Terms and Conditions are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising from or related to the Site or these Terms and Conditions must be brought in a court of competent jurisdiction located in Illinois, and you consent to the jurisdiction of those courts, except where applicable law provides otherwise. 

  

15 Changes to These Terms 

  

We may revise these Terms and Conditions periodically. The updated version will be posted on the Site with a revised effective date. Your continued use of the Site after revised terms become effective means you accept the updated terms. 

  

16 General Provisions 

  

If any provision of these Terms and Conditions is found unenforceable, it will be modified to the minimum extent needed or severed, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms and Conditions without our written consent. We may assign them in connection with a reorganization, transaction, project transfer, or operation of the Site. These Terms and Conditions and the Privacy Policy form the entire agreement concerning your use of the Site.
